With the shutdown of multiple Twitter feeds, including Deadspin and SBNationGif, going down on Monday for various (and numerous) copyright infringements, the internet was aflutter that big media once again cracking down on the relatively harmless yet clearly illegal use of proprietary content online.

Many questions came from the shutdowns. First, who was responsible for getting those accounts suspended? Second, and perhaps most importantly, what will social media sites like Twitter do in the future when media companies continue to post content without expressed written consent (or implied oral consent) of those who hold the rights?

This has been an issue for years, and it’s somewhat ironic that writers on the internet rightly call out others for plagiarism—the worst offense in journalism—yet routinely steal video content without paying for the rights. Making something into a gif undoubtedly serves the greater sports-loving audience, and one can make the case it helps grow the conversation and interest in a particular sport, but television companies pay billions of dollars for us to watch games and highlights, and the leagues have a legal responsibility to protect those rights.

Sure, some leagues protect those rights a little too much, but for what it’s worth, business is business. This business, as we’ve seen, is worth a lot.

Awful Announcing reached out to Twitter for information about the accounts that were shut down to see who had requested the unlicensed material to be deleted. Here is a statement from Nu Wexler of Public Policy Communications for Twitter.

We don’t comment on individual accounts, but I’ve attached two batches of Digital Millennium Copyright Act (DMCA) notices related to your inquiry. We submit all actioned takedown notices to the Chilling Effects Clearinghouse. 
Our Copyright and DMCA policy explains the process for formally reporting copyright infringement, as well as providing instructions on how an affected party can appeal a removal by submitting a compliant counter-notice.

Many of us thought MLB would be the big bad, but as you can see in this series of Digital Millennium Copyright Act (DMCA) notices below, it was the NFL—through a London-based company called NetResult Solutions, which has been in business for nearly 15 years serving as an internet copyright watchdog for many major sports leagues around the world—as well as the Big XII and SEC—both through a company called XOS Digital—that led the charge to have these feeds shut down.

You can also see within the DMCA notices that XOS Digital particularly went after SBNationGIF, while the only complaint specifically logged at Deadspin was by the UFC. (The UFC complaint went to this Deadspin tweet from the last Ronda Rousey fight and contained a no-distribution policy, so it’s not posted below. It also asks that any and all accounts attached to the offending tweet be terminated by Twitter.) The NFL complaints, which were plentiful, referenced specific tweets, images or videos, not direct Twitter accounts.
